1. Call to Order & Introductions

Scott Leathersich, Planning Committee Chairperson, called the meeting to order at 10:07 a.m. Members, Alternates, and others present introduced themselves.
 

2. Public Forum

Christine Quinlan, Village of Avon Treasurer, spoke regarding the Erie-Attica Trail to Avon project to be considered as Proposed Council Resolution 13-159. She explained that the request is to cover the cost of relocating a buried gas line to meet ADA slope requirements. During the initial project development it was thought that the gas line would not be impacted. Christine also noted that the ribbon cutting for the project is scheduled for November 15.

3. Approval of Minutes

Richard Perrin indicated that two errors were discovered in the draft October 10, 2013 Planning Committee meeting minutes that need to be corrected. These include the anticipated date for the Livingston County Transportation Connectivity Plan Open House, which is November 19, and the addition of a statement made by Gerald Lederthiel during the second Public Forum of that meeting that the Irondequoit Bay Outlet Bridge should be opened to vehicles earlier than November 1 this year due to the recent, unplanned lane closures on the Route 104 Bridge over Irondequoit Bay.

Terrence Rice moved for approval of the minutes from the October 10 Planning Committee meeting as corrected; David Cook seconded the motion. The minutes were approved as corrected.

4. Reports and Action on Old Business

a.      Reports of UPWP Projects and Other Activities

 

GTC

 

Richard Perrin reported:

         GTC staff has expended a large amount of effort and made significant progress on the development of the strategic plan for fiscal years 2014-2015 through 2016-2017. Strength, Weaknesses, Opportunities, and Threats analyses were conducted for five Key Result Areas and associated action items have been identified and prioritized. Richard thanked staff for their work in advancing this initiative. GTC worked with the Association of Metropolitan Planning Organizations (AMPO) and NYSAMPO to develop and submit comments on proposed FHWA/FTA policy guidance on transit representation on MPOs by the October 30 deadline. Fisher Associates has taken the lead on scheduling a roundtable of federal and state elected officials to discuss transportation funding issues, and is working with GTC staff, Monroe County DOT, and others on this event. Richard thanked Fisher Associates for its efforts in facilitating the roundtable.

         Regional Traffic Count Collection: There is no funding for additional counts in the FY 2013-2014 Unified Planning Work Program (UPWP), activities will be limited to analysis and dissemination of the data by GTC staff. GTC staff submitted a proposal for the FY 2014-2015 UPWP to conduct counts in the seven counties that responded they would participate in the program. Richard explained that in addition to coordinating with the participating counties, GTC is also working with the state to avoid duplication of effort.

        LRTP Update/Implementation: The development of a transportation system status report that provides updated data for the Long Range Transportation Plan for the Genesee-Finger Lakes Region 2035 (LRTP 2035) performance measures and the activities accomplished since the adoption of the LRTP 2035 is continuing. Work activities include data analysis, amplification of relevant developments affecting LRTP 2035 Emerging Opportunities and Issues, and document layout and design.

         Genesee-Finger Lakes Regional Critical Transportation Infrastructure Vulnerability Assessment: The draft Request for Proposals (RFP) has been revised based on comments by member agencies and other stakeholders. The draft RFP has been provided to the NYS Division of Homeland Security and Emergency Services (NYSDHSES), whose comments have been requested by November 15. GTC staff expect to issue the RFP shortly after considering any NYSDHSES comments.

         Diversion Route Planning Initiative: GTC staff is finalizing the draft response to the consultant's letter with guidance on our expectations for the remainder of the project.

         Congestion Management Process (CMP): The update of the CMP is included in the LRTP 2035 that was adopted by the Board on June 16, 2011. The CMP Technical Documentation report that expands on the information included in the LRTP 2035 was accepted by the GTC Board at its June 20 meeting. GTC will be participating in an FHWA-sponsored project on incorporating reliability performance measures into the CMP.

        Greater Rochester Regional Commuter Choice Program: GTC staff submitted a FY 2014-2015 UPWP proposal to continue the website, as well as increase its marketing. GTC staff provided a demonstration of how the site could be used to coordinate rides provided by volunteer drivers of human service agencies to Heritage Christian Services, Lifespan, and Medical Motor Service on October 31.

         Travel Time Data Collection Program: GTC staff are working with the data provider (INRIX) on the development of an agreement for use of the data and associated analytic software by member agencies. A draft of the agreement with GTC staff-proposed language was provided on November 11.

        Regional Mobility Management Business Plan: The single proposal received by the September 27 deadline was deemed not adequate by the proposal evaluation committee. Accordingly, GTC staff will consider other options for advancing mobility management planning in the region.

         Genesee-Finger Lakes Regional Trails Initiative Update: Eight proposals were received by the November 7 deadline. Approval to enter into a contract with the preferred consultant is expected on December 17.

         Rochester Area Bike Sharing Program Study: Approval to enter into a contract with the preferred Consultant selection was obtained on November 13.

Genesee County

Richard Perrin reported:

         Genesee County Horizontal Curve Sign Study: The study was accepted by the GTC Board at its June 20 meeting.
 

G/FLRPC

David Zorn reported:

         Regional Land Use Monitoring Report: The 2012 Report was accepted by the GTC Board at its September 12 meeting.

         Inventory and Mapping of Regional Zoning District Boundaries and Inventory of Land Use: Initial digitization has begun and municipal follow up is underway.

         Regional Rights-of-Way Study: Research and data acquisition are underway. The advisory group met via conference call to discuss data and mapping needs.

         Genesee-Finger Lakes Region Population Projections: The project was accepted by the GTC Board at its June 20 meeting.

         Planning for Transportation and Climate Change: No progress to report.

         Regional Atlas: Initial layout, design, and draft section development are complete and it is anticipated that an initial draft will be provided for review by November 15.

Livingston County

Angela Ellis reported:

         Dansville Transportation and Commercial & Industrial Access Study: The County Board of Supervisors approved the preferred consultant on October 9 and contract execution is underway. A project kick-off is anticipated for December 2013 or early-January 2014.

        Livingston County Transportation Connectivity Plan: Advisory Committee Meetings as well as a Public Meeting are set for November 19 and the project is anticipated to be complete by the end of the year.
 

Monroe County

Terry Rice reported:

        Monroe County High Accident Location Program: A new list has been developed that includes 54 locations. Five additional sites have been analyzed for a total of eight (15 percent).

Ontario County

Richard Perrin reported:

         Routes 5 & 20 and State Route 364 Multi-Modal Study: The study was accepted by the GTC Board at its September 12 meeting.

City of Rochester

Erik Frisch reported:

        Urban Trail Linkages: No progress to report.

        JOSANA Trail Feasibility Study: The RFP is on hold at this time.

        Mt. Read Boulevard Corridor Study: The consultant met with staff on November 12 to review initial draft alternatives for the corridor. An advisory committee is anticipated for December with a public meeting anticipated for January 2014.

        Rochester Bicycle Boulevard Plan: The project kick-off meeting was held October 16 to discuss the project concept, goals, and data needs. Data collection and analysis is underway.

Terrence Rice asked about the alternatives for the Mt. Read Boulevard study. Erik Frisch responded that the City and its consultant met with representatives from Monroe County DOT and NYSDOT on November 12 to review the alternatives. The comments will be addressed before sending a draft report to the full steering committee.

RGRTA

David Cook reported:

       RGRTA Transit-Supportive Development Guidelines: RGRTA does not wish to advance this project and is requesting that GTC make the funds available for reprogramming.

Richard Perrin noted that the funds would be reprogrammed as part of the development of the FY 2014-2015 UPWP.

       RGRTA Route Analysis: This project is ongoing and Crystal Benjamin provided a presentation at the October 10 Planning Committee meeting.

       RTS Route Overhaul and Refinement Analysis: This project is ongoing and Crystal Benjamin provided a presentation at the October 10 Planning Committee meeting.

         Bus Stop Optimization Study: Approval to enter into a contract with the preferred Consultant selection was obtained on November 13. There are more than 4,000 bus stops in the Rochester Area and this is an important initiative to meet the needs of customers through improved stop location and operations.

Terrence Rice noted that RGRTA should work with the City of Rochester as well as Monroe County to ensure that the road owners are involved as the study is undertaken and recommendations are developed. David responded that he will pass these comments on to the project manager to ensure that theyre addressed.

Wayne County

Kevin Rooney reported:

        Wayne County Horizontal Curve Sign Study: The study was accepted by the GTC Board at its June 20 meeting.

Wyoming County

         Wyoming County Horizontal Curve Sign Study: The study was accepted by the GTC Board at its June 20 meeting.

Other Agencies

Richard Perrin reported:

         Auburn Trail Connection to the Ontario Pathways Trail: The study was accepted by the GTC Board at its June 20 meeting.

         Irondequoit Seneca Multi-Use Trail Feasibility Study: The study is being finalized based on comments received. Closeout is expected at the January 2014 Planning Committee meeting.

         Black Creek Stream Corridor Trail Feasibility Study: The study was accepted by the GTC Board at its June 20 meeting.

         Village of Scottsville Traffic Circulation and Safety Study: The study was accepted by the GTC Board at its September 12 meeting.

         Webster Village Core Circulation, Accessibility, and Parking Study: A Public Meeting was held on October 30 and the final report is being produced.

         East Rochester Transportation Improvement Study: The first Steering Committee meeting was held October 15 and the initial public open house is scheduled for November 18.

         Victor Transportation Systems Plan: A formal presentation on the findings of the Traffic Task Force was made to the Town Board on October 28. The full comprehensive plan update is expected to be finalized by the end of the year. A presentation is expected at the January 2014 Planning Committee meeting.

         NYS Route 250 Transit Supportive Mixed Use Development District: A visit to the Manitou Lake site was conducted October 28. The 80 percent draft is under review by the steering committee and the next meeting of that group has been scheduled for November 19.

         Town of Penfield Transit Supportive Mixed Use Development District: The RFP has been finalized and will be advertised when the "80 percent" design manual for Task 8514 is complete.

         Brighton Bicycle and Pedestrian Trail Plan: The study was accepted by the GTC Board at its June 20 meeting.

         Town of Greece Active Transportation Plan: Initial alternatives are expected to be provided to the Steering Committee in mid-November for discussion on December 16.

         Village of Pittsford Active Transportation Safety Plan: No progress to report.

         Town of Chili Bicycle and Pedestrian Planning Study: The RFP was reviewed and approved by stakeholders and advertised on October 28.

         Town of Perinton Active Transportation Plan: No progress to report.

Richard Perrin provided a report on the funding made available by the short-term Continuing Resolution passed by Congress and signed by the President on October 16. He noted that key provisions include funding through January 15, 2014 along with a debt limit suspension through February 7, 2014. The Continuing Resolution also incorporates the March 1 sequestration order, and apportions 29.32 percent of that base rate for every appropriated budget account. Richard noted that any account that existed in FY 2013 but which got zero funding in either the House or Senate version of its appropriation bill does not get funded under the Continuing Resolution; this includes the Transportation Investment Generating Economic Recovery (TIGER) program.

b.     Any Other Old Business or Announcements
 

1.      Action concerning recommending the acceptance of the Urban Trail Linkages Eastman and Genesee Riverway Trails Planning and Preliminary Design Study as evidence of completion of UPWP Task 6524 / Proposed Council Resolution 13-62 (City of Rochester)

Erik Frisch stated that he had nothing new to report at this time and hopes to have any issues associated with Monroe County DOTs comments on the project resolved in early-2014.

2.      Update on FY 2014-2015 Unified Planning Work Program (GTC staff)

Richard Perrin stated that the FY 2014-2015 UPWP Call for Projects was issued on Friday, September 13. An applicant workshop was held on Wednesday, September 25 at the Henrietta Town Hall.

Nineteen proposals requesting $1,222,400 in federal transportation planning funds were received by the Friday, October 18 deadline. This is slightly fewer than the 22 proposals that were received requesting $1,322,255 in FY 2013-2014. Richard noted that there is $1,070,361 ($802,589 FHWA PL and $267,772 FTA MPP) available for programming in the FY 2014-2015 UPWP which is very similar to the $1,097,760 ($882,760 FHWA PL and $215,000 FTA MPP) in funding that was available in in FY 2013-2014.

The submitted proposals, an associated summary, and the evaluation form used by GTC staff were distributed to the UPWP Development Committee (UDC) on Saturday, October 19. The 19 proposals were evaluated by GTC staff based on the information contained in the applications. The UDC will meet as necessary to review the proposals and discuss additional factors based on their professional judgment. The first meeting of the UDC will be held after this Planning Committee meeting and additional meetings have been scheduled for November 26, December 5, and December 9.

A draft FY 2014-2015 UPWP will be developed for presentation to and consideration by the Planning Committee at its January 9, 2014 meeting. Based on any changes made at that meeting, an initial draft program will be approved for 30-day public review and a final draft program for Board adoption will be recommended by the Planning Committee at its February 13, 2014 meeting. The Board will consider the final draft FY 2014-2015 UPWP at its March 13, 2014 meeting and the adopted UPWP will take effect April 1, 2014.
 

3.      Update on TIP Project Delivery Review (GTC staff)

GTC staff had intended to provide a presentation to the TIP Development Committee (TDC) at its October 31 meeting. However, given the number of TIP amendments received and required follow-up activities on them, this did not occur. GTC staff are considering scheduling a special meeting of the TDC to ensure there is adequate time allowed for consideration and discussion.

Dan Hallowell noted that NYSDOT provided its annual report to FHWA regarding project delivery. He indicated that NYSDOT measures project delivery in two ways the program, as amended, and the program, not amended (i.e., the program in place at the beginning of the Federal Fiscal Year). Dan stated that this region delivered 88 percent of the not amended program. This region was the only one to exceed the statewide goal and indicates that we delivered the program we intended to in FFY 2013.

Dan Hallowell congratulated Richard Perrin on his recent election as President of the Association of Metropolitan Planning Organizations.

5. Action Items

a.      Action concerning amending the FY 2013-2014 UPWP to accept Federal Highway Administration Statewide Planning and Research Funds for Task 8780 Rochester Area Bike Sharing Program Study / Proposed Council Resolution 13-154
 

Richard Perrin described the background to the proposed amendment including the purpose and need for Task 8780, GTCs success in seeking Statewide Planning and Research (SPR) funds to conduct the Bike Sharing Program Study, and the need to ensure that the project budget can accommodate the reporting requirements associated with the SPR funding obtained.

Erik Frisch moved to approve Proposed Council Resolution 13-154; Kevin Rooney seconded the motion. The motion passed unopposed.
 

b.     Recommendation to the GTC Board concerning amending the 2014-2017 Transportation Improvement Program / Proposed Council Resolutions 13-155 through 13-197

Scott Leathersich proposed that the TIP amendments be grouped together and voted on in a single motion. No members or alternates objected. Richard Perrin stated that he would provide an overview of the amendments and funding sources (including offsets if any) and offered to answer any questions on the proposed actions.
 

1.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the STP-Flex Block Program project / Proposed Council Resolution 13-155 (NYSDOT)

Richard Perrin noted that this amendment is requested by NYSDOT on behalf of several project sponsors and provides offset funding for items 2 through 7, below.
 

2.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Twin Bridge Road over Oatka Creek and Oatka Creek Tributary project / Proposed Council Resolution 13-156 (Monroe County)

Richard Perrin stated that this change reconciles the final project costs and an offset for this project is provided by item 1, above.
 

3.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Walnut Street Bridge over Keshequa Creek project / Proposed Council Resolution 13-157 (NYSDOT)

Richard Perrin stated that this change reconciles the final project costs and an offset for this project is provided by item 1, above.
 

4.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by increasing the cost of the Livingston County Bridge Preventive Maintenance project / Proposed Council Resolution 13-158 (NYSDOT)

Richard Perrin stated that this change reconciles the final project costs and an offset for this project is provided by item 1, above.
 

5.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Erie-Attica Trail to Avon project / Proposed Council Resolution 13-159 (NYSDOT)

Richard Perrin stated that Ontario County was not able to gain approval for Right-of-Way Acquisition in FFY 2013 as programmed and an offset for this project is provided by item 1, above.
 

7.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Old Mill Road Bridge over Flint Creek project / Proposed Council Resolution 13-161 (NYSDOT)

Richard Perrin stated that Ontario County was not able to gain approval for Right-of-Way Acquisition in FFY 2013 as programmed and an offset for this project is provided by item 1, above.
 

8.      Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the STP-Urban Block Program project / Proposed Council Resolution 13-162 (NYSDOT)

17.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Portageville Bridge project / Proposed Council Resolution 13-171 (NYSDOT)

Richard Perrin noted that this amendment is requested by NYSDOT and the source of federal funds is a NYSDOT-Main Office set-aside from the Congestion Management and Air Quality Improvement Program. Richard also discussed the significance of this bridge to statewide, national, and international freight movements.
 

18.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by increasing the cost of the I-490 EB to Route 590 NB Safety Improvements project / Proposed Council Resolution 13-172 (NYSDOT)

Richard Perrin noted that this amendment is requested by NYSDOT and the source of additional federal funds is the Highway Safety Improvement Program set-aside administered by NYSDOT-Main Office.
 

19.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the Inner Loop Bridge over Brown's Raceway project / Proposed Council Resolution 13-173 (NYSDOT)

Richard Perrin noted that NYSDOT has revised its cost estimate and this action provides offsets for items 23 and 24, below.
 

20.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the Interstate System Preventive Maintenance (2014) project / Proposed Council Resolution 13-174 (NYSDOT)

Richard Perrin noted that NYSDOT has revised its cost estimate and this action provides an offset for item 23, below.
 

21.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the I-390 Interchange Improvements @ Rt. 15 (Exit 16 Part 2) project / Proposed Council Resolution 13-175 (NYSDOT)

Richard Perrin noted that NYSDOT has revised its cost estimate and this action provides offsets for items 24, 25, 26, 27, and 28, below.
 

22.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by decreasing the cost of the NYSDOT Principal Art. or Higher Prev. Maint. @ 5 Locations (2015) project / Proposed Council Resolution 13-176 (NYSDOT)

Richard Perrin noted that NYSDOT has revised its cost estimate and this action provides offsets for items 26, 29, 30, and 31, below.
 

23.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by increasing the cost of and advancing select phases of the Route 104 Irondequoit and Webster Bridge Painting (FFY 2016) project / Proposed Council Resolution 13-177 (NYSDOT)

Richard Perrin noted that NYSDOT has revised its cost estimate and has an opportunity to accelerate this project. An offset is provided by items 19 and 20, above.

39.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by deleting the Vouchers for Disabled Veterans to Ride Lift Line Services project / Proposed Council Resolution 13-193 (RGRTA)

Richard Perrin noted that this amendment is requested by RGRTA and per Resolution 13-153, the funding for this project was made available in Federal Fiscal Year 2013 and the project is currently being advanced.
 

40.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the John Street Extension, Bailey Rd. to Lehigh Station Rd. project / Proposed Council Resolution 13-194 (NYSDOT)

Richard Perrin noted that this change reconciles the final project costs and the source of federal funds is an earmark with no impact on other projects.
 

41.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by adding the Monroe Co. Camera Deployment & ITS Integration Stage 5 project / Proposed Council Resolution 13-195 (NYSDOT)

Richard Perrin noted that this is a new project and the source of federal funds is an earmark with no impact on other projects. The funding reflects cost savings on a previous stage of this initiative.
 

42.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by increasing the cost of the Downtown Two-Way Conversion Phase II project / Proposed Council Resolution 13-196 (City of Rochester)

Richard Perrin noted that a phase of this project was not able to be obligated in FFY 2013 as programmed and the source of federal funds is an earmark with no impact on other projects.
 

43.  Recommendation to the GTC Board concerning amending the 2014-2017 TIP by consolidating the Broad Street Preventive Maintenance project and the Broad Street Tunnel East Approach/ Aqueduct project / Proposed Council Resolution 13-197 (City of Rochester)

Richard Perrin noted that this amendment is requested by the City of Rochester and the sources of federal funds are the STP-Urban Program and an earmark. Erik Frisch noted that this amendment consolidates two projects with FHWA concurrence.

Dan Hallowell stated that the new preventive maintenance projects, items 30 and 31 above, are relatively simple and can be delivered in FFY 2014. These projects were originally programmed with State funds only. NYSDOT still intends to deliver the locations identified in the TIP application for item 22 above.

Dan added that he would like to have a discussion on flexibility for programming preventive maintenance projects since the best candidates cannot be identified as far in advance as the last year of the TIP when it is developed. Scott Leathersich stated that such a discussion should occur at the TIP Development Committee first.

Kevin Rooney moved to recommend that the GTC Board adopt Council Resolutions 13-155 through 13-197; Daniel Hallowell seconded the motion. The motion passed unopposed.
 

6. New Business
 

a. 2014 Meeting Calendar

Richard Perrin noted that the 2014 Meeting Calendar is included with the meeting materials.
 

b. Discussion on Status of Funding for the Remaining Phases of Access 390 Initiative (GTC Staff)
 

Richard Perrin reported that when the 2014-2017 TIP was being developed, NYSDOT-Main Office conducted two separate solicitations for the Statewide Prioritization and Strategic Transportation Enhancement programs. The remaining phases of the Access 390 Initiative were submitted for both solicitations. No decision has yet been made by NYSDOT-Main Office on the selection of any projects submitted as part of these solicitations to receive construction funding.

Phase 4 of the Access 390 Initiative (I-390 Interchange Improvements at Exit 16 [NYS Route 15A/East Henrietta Road]) is included in the 2014-2017 TIP as it ranked high enough to receive funding. Given the commitment to the full project by the Governor that had been reported in January 2012, several projects were identified during the development of the 2014-2017 TIP to receive the $17.62 million in federal funds that would become available when Phase 4 of the Access 390 Initiative is programmed with funds from the statewide set aside (the Yellow List). The 2014-2017 Statewide TIP (2014-2017 STIP) was approved by FHWA and FTA and includes approximately $1 billion in unprogrammed National Highway Performance Program (NHPP) funds, of which a portion could be awarded to Phase 4 of the Access 390 Initiative.

Richard stated that NYSDOT cannot advance Phase 4 of the Access 390 Initiative without also advancing Phase 3 (I-390 Interchange Improvements at NYS Route 15A/East Henrietta Road over the Erie Canal), which is not funded in the 2014-2017 TIP. Accordingly, Richard suggested that it may be prudent to begin considering the reprogramming of funds from Phase 4 of the Access 390 Initiative (since it cannot advance) to the Yellow List.

Dan Hallowell responded that NYSDOT-Main Office has not programmed any funds for construction of projects submitted through the statewide solicitations. The region has received authorization to program design activities for two projects submitted through the statewide solicitation. NYSDOT-Region 4 has requested construction funding for the remaining phases of the Access 390 Initiative from NYSDOT-Main Office.

Dan reminded the Committee that it is not the practice of GTC to reprogram funds without the project sponsors concurrence and that the Yellow List is based on a funding scenario that has not come to fruition. He feels we should go back to the tiered lists and take another look at Phase 3 and the Route 31 (Lyell Avenue) bridge over NYS Route 390. Since the 2014-2017 TIP was developed, NYSDOT-Region 4 has been able to confirm that Phase 3 of the Access 390 Initiative is eligible for NHPP funds, which was not certain at the time. Also, NYSDOT-Region 4 sees this bridge as integral to the entire interchange reconfiguration and not a stand-alone bridge project; as such, it should be evaluated in that context.

Terrence Rice noted that just having this discussion at the MPO table may prod NYSDOT-Main Office to make a decision and that it is a fact that this region received less than its fair share of funding from the total that was distributed to the regions for programming. Dan responded that federal funds are not an entitlement program and NYSDOT-Main Office is assessing the significance of the projects submitted through the solicitations on a statewide basis.

Erik Frisch asked about the timing of the Access 390 projects. Dan Hallowell responded that NYSDOT would like to start construction on I-390 in 2017 so construction of the Phase 3 would need to start in 2015. He has asked NYSDOT-Main Office to consider using the design-build approach for the remaining phases. He noted this is possible since design approval is already in place, however, the design-build legislation would need to be extended and NYSDOT-Main Office approval would be needed.

David Cook asked Dan Hallowell if he has any sense of how this region performed with respect to utilizing funds made available to New York State through the American Recovery and Reinvestment Act (ARRA). Dan responded that he does not have specific figures but does know that New York State took advantage of the flexibility to make local project sponsors whole.

7. Public Forum
 

Tom Lichtenthal stated that he was under the impression that the purpose of the Yellow List in the 2014-2017 TIP public review document was to identify projects to advance if Phases 3 and 4 of the Access 390 Initiative received funding from the statewide set aside. Dan Hallowell responded that the Yellow List was based on a scenario that doesnt look like it will happen.
